Build Your Own! : What will your contract be?

It probably looked quite obvious which one was the ‘good’ contract, and which one was the ‘bad’ contract. You can probably see why contracts become so long now! Did you notice how both contracts are trying to achieve the same thing; a clean car?

Below we go through Contract 1, the better contract, to look at why it is the better one before you write your own!

Contract

I, Ceri Blower (‘Ceri‘), of 123 Brightside Avenue, enter into a contract with Nicoleen Wong (‘Nicoleen‘), of 46 Green Lane, on the date of 3rd January 2020

Positive Points

  • Use of full names and address‘, to make sure there is no confusion over who is involved in the contract!
  • Date the contract is made so we know when it is in force
  • Names in brackets so there is no confusion who ‘Ceri’ is when the short name is used later

Ceri agrees to clean the car of Nicoleen once a week, starting on the 6th January 2020 at a time agreed upon by the parties between the hours of 9am and 5pm. Cleaning of the car will take place at Nicoleen’s residence, at 46 Green Lane.

  • Date Ceri is to start carrying out her part of the contract
  • Times the parties can agree for the cleaning to take place
  • Where the cleaning takes place

The cleaning of the car will include washing the outside of the car, hoovering the inside along with maintaining the air pressure in the car’s wheels. 

  •  What cleaning means, so Ceri can’t just put a hose on the car and ask for her £10

The rate of pay will be £10 per car cleaning session, paid to Ceri in cash at the completion of each cleaning.

  • How much Ceri is to be paid, and when it should be paid

This contract can be terminated by either of the parties providing they give 2 clear weeks notice.

  • How the contract can be cancelled agreed from the beginning so no arguments can occur if the contract ends
 
  • Signed and dated by each party so we know when they both agreed and that they agreed. 
 

Stretch Activity:

No contract is perfect, can you think of any ways you would improve the above contract? For example, what would happens if Ceri and Nicoleen can’t agree what time between 9am-5pm for the cleaning to take place? It’s not clear in the contract which means the contract has missed something!
